Terms of Use — Compalight

1. Scope and Provider
These Terms of Use govern the use of the iOS application Compalight, provided by:

By using the app you agree to these Terms. Compalight is provided free of charge, with no in-app purchases and no subscriptions.
2. Description of Services
Compalight is a text markup and change-tracking editor. The app provides word-accurate diff display, OCR text import from camera or photo library, speech-to-text dictation, and export to Word, PDF, and plain text formats. All processing takes place locally on your device.
3. Licence
You receive a non-exclusive, non-transferable licence to use Compalight on devices linked to your Apple ID, subject to Apple's Standard End User Licence Agreement (EULA) and these Terms. The agreement is between you and D. Stengel-Dori; Apple is not a party to it.
4. Permitted Use
You agree not to use Compalight for unlawful purposes, not to reverse-engineer or disassemble the app, and to comply with applicable law.
5. OCR and Speech Recognition — Accuracy and User Responsibility
OCR (optical character recognition) and speech recognition are automated processes that are susceptible to errors. Factors such as print quality, lighting, typeface, dialect, or ambient noise can affect recognition accuracy.
The user is obligated to carefully read and verify all text produced by OCR or speech recognition before any further use — in particular before any legal, professional, or commercial use. Unrecognised or incorrectly recognised words can substantially alter the meaning of a text.
As Compalight is provided free of charge, D. Stengel-Dori's liability for damage arising from inaccurate or incomplete text recognition is limited to cases of intent or gross negligence (§§ 521, 599 BGB by analogy).
6. Limitation of Liability
Liability is limited to intent and gross negligence. Liability for slight negligence is excluded unless there is injury to life, body, or health, or a breach of material contractual obligations (cardinal obligations). In the event of a breach of cardinal obligations, liability is limited to the foreseeable damage typical for the contract. Liability under the Product Liability Act and other mandatory statutory provisions remains unaffected.
As all data is stored locally on the user's device, D. Stengel-Dori is not liable for data loss resulting from device failures, operating system updates, or user actions.
7. Availability
D. Stengel-Dori does not guarantee uninterrupted availability of the app or error-free operation. Updates and bug fixes will be provided where possible but are not guaranteed. Statutory warranty rights remain unaffected.
8. Intellectual Property
The app, its design, source code, and all content are protected by copyright. The user may not decompile, disassemble, reverse-engineer, or distribute the app.
9. Governing Law and Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, the mandatory protective provisions of the law of their country of habitual residence remain applicable (Art. 6(2) Rome I Regulation). Jurisdiction for merchants and legal entities under public law is Frankfurt am Main.
10. Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
11. Amendments to These Terms
D. Stengel-Dori reserves the right to amend these Terms of Use. Material changes will be communicated on the next app launch via an in-app notice requiring explicit re-acknowledgement. The current version is available at any time in the app under Settings and at the following link. Users who do not accept a change may delete the app at any time; as the app is free of charge, no disadvantage arises from doing so.
12. Severability
If any provision of these Terms is found to be invalid, the remaining provisions shall not be affected.
